Chinese Pokémon Knockoff Loses Copyright Suit

近日，Pokémon公司在针对多家中国公司侵犯其知识产权的诉讼中取得了胜利，法院判决侵权方赔偿1500万美元。这场旷日持久的法律战始于2021年12月，Pokémon公司指控被告开发了一款名为“口袋妖怪复刻版”的手机游戏，公然抄袭了其宝可梦角色、生物和核心游戏机制。
山寨游戏抄袭证据确凿
这款于2015年推出的手机RPG游戏，其角色设计与宝可梦系列惊人相似，例如酷似皮卡丘和小智的角色形象，以及与宝可梦系列如出一辙的回合制战斗和收集生物的游戏机制。虽然Pokémon公司并不拥有“收集怪物”这一游戏模式的独家版权，但他们认为“口袋妖怪复刻版”已经超越了“灵感借鉴”的范畴，而沦为赤裸裸的剽窃。
例如，这款游戏的应用图标使用了与宝可梦黄版包装盒相同的皮卡丘图像；其广告中则大张旗鼓地展示了小智、水箭龟、皮卡丘和暖暖猪等角色，甚至连颜色都没有更改；此外，网络上流传的游戏画面也显示了众多熟悉的宝可梦角色，例如黑白2中的女主角Rosa和喷火龙。
2022年9月，关于此诉讼的消息首次曝光，Pokémon公司最初索赔高达7250万美元，并要求被告在中国主要网站和社交媒体平台上公开道歉，同时停止该侵权游戏的开发、发行和推广。
深圳中级人民法院最终支持了Pokémon公司的诉求。虽然最终判决金额低于最初的索赔额，但1500万美元的赔偿金仍然向试图利用知名IP牟利的开发者发出了强烈的警告。据悉，六家被告公司中有三家已提出上诉。
GameBiz网站的文章中，Pokémon公司向粉丝们保证，“我们将继续努力保护其知识产权，以便世界各地的许多用户都能安心地享受宝可梦内容。”
Pokémon公司对粉丝作品的态度
Pokémon公司过去曾因关闭粉丝项目而受到批评。Pokémon公司前首席法律官唐·麦高文在3月份接受Aftermath采访时透露，在他任职期间，公司并没有主动寻找并关闭粉丝项目。相反，公司主要是在这些项目越线时才采取行动。
麦高文表示：“你不会立即发出删除通知。你会等待看看他们是否获得资助，例如Kickstarter之类的。如果他们获得了资助，那时你才会介入。没有人喜欢起诉粉丝。”
麦高文强调，Pokémon公司的法律团队通常是通过媒体报道或个人发现才了解到粉丝项目的存在。他将此比作教授娱乐法，他建议学生们，获得媒体关注可能会无意中将他们的项目带到公司的视线中。
尽管如此，Pokémon公司也曾对一些影响力较小的粉丝项目发出过删除通知，包括粉丝自制创作工具、类似《宝可梦铀》的游戏，甚至还有包含粉丝自制宝可梦狩猎FPS的病毒视频。
